Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of GetSwapped, including the website at www.getswapped.app and any related applications, features, and services (together, the “Service”). The Service is operated by Arche Labs Ltd (“Arche Labs Ltd,” “we,” “us,” or “our”). Please read these Terms carefully. They include important information about consent, automatic renewal, limitations of our liability, and how disputes are resolved.

1. Acceptance of these Terms

By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms, our Privacy Policy, our Acceptable Use Policy, and our Refund & Cancellation Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Service. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old, and of legal age to form a binding contract where you live, to create an account or use the Service. The Service is not directed to children and may not be used by or on behalf of anyone under 18. You may not use the Service if you have previously been banned from it or if doing so would violate any law that applies to you.

3. Your account

You must provide accurate and complete information when you register and keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at getswapped.com@gmail.com if you believe your account has been accessed without authorization. Accounts are personal and may not be shared, sold, or transferred.

4. Description of the Service

GetSwapped is an online tool that uses artificial intelligence to create face and character swaps. You upload a photo of yourself (or of a person who has given you explicit permission), choose a target video or image — either your own upload or a template we provide — and the Service generates a new image or short video clip in which that face appears in the chosen scene (an “Output”). The Service is delivered entirely online; there are no physical goods.

We continuously improve the Service and may add, change, or remove features, templates, output resolutions, or supported formats over time. Processing times vary with demand and the complexity of each request. If a change materially reduces what your paid plan includes, we will tell you in advance, and you may cancel and receive a pro-rata refund for the rest of your billing period.

5. Subscriptions, credits, and billing

Plans and pricing

Access to generation features requires a paid monthly subscription. Prices are listed in USD on our pricing page. Our current plans are:

  • Starter — $9 USD per month, including 100 credits per billing period.
  • Pro — $29 USD per month, including 400 credits per billing period.
  • Creator — $79 USD per month, including 1,200 credits per billing period.

Credits

Each generation consumes credits. At the date of these Terms, an image swap costs 2 credits and a video swap costs 10 credits per clip of up to 10 seconds. The credit cost of a generation is shown in the app before you confirm it. Credits are granted at the start of each billing period, reset at the end of that period, and do not roll over to the next period. Credits have no cash value, are not redeemable for money, and may not be sold, transferred, or exchanged. If a generation fails because of an error on our side or our provider’s side, the credits used for it are automatically returned to your balance.

Billing and automatic renewal

Payments are processed by our payment processor, Stripe. By starting a subscription, you authorize us (through Stripe) to charge your chosen payment method the applicable monthly fee, plus any applicable taxes, at the start of your subscription and then automatically on the same day of each following month until you cancel. Your subscription renews automatically for successive one-month periods unless you cancel before the renewal date. If a payment fails, we may retry the charge and may suspend generation features until the balance is paid.

Price changes and taxes

We may change subscription prices or the credits included in a plan. We will give you at least 14 days’ notice by email before a price increase takes effect, and the new price will apply from your next billing period. If you do not agree to the change, you may cancel before it takes effect.

For customers in the EU and UK, listed prices include VAT. For customers elsewhere, listed prices exclude sales tax, GST, or similar taxes, which are calculated and added at checkout where required by law.

Changing plans

You can upgrade or downgrade from the billing portal or by contacting support at getswapped.com@gmail.com. Upgrades take effect immediately and any price difference is prorated. Downgrades take effect at the start of your next billing period.

6. Cancellation and refunds

You can cancel your subscription at any time online from the billing portal linked in every receipt email, or by emailing getswapped.com@gmail.com. Cancellation takes effect at the end of your current billing period: you keep access to your plan and remaining credits until then, and you will not be charged again. Refund eligibility, including our first-payment refund window and statutory withdrawal rights for consumers in the EU and UK, is described in our Refund & Cancellation Policy.

7. Your content

“Inputs” means the photos, videos, and other material you upload or submit to the Service. As between you and Arche Labs Ltd, you retain all rights you hold in your Inputs, and, subject to these Terms and to any rights of third parties (including people depicted and the owners of any source footage), you own the Outputs generated for you. We do not claim ownership of your Inputs or Outputs.

You grant Arche Labs Ltd and our service providers a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, and display your Inputs and Outputs solely as needed to operate, provide, secure, and support the Service for you, to comply with law, and to enforce these Terms. This license ends when your content is deleted from our systems, as described in our Privacy Policy. We do not use your Inputs or Outputs to train AI models, and we do not use them in our marketing without your separate, explicit permission.

Because of how AI generation works, Outputs created for other users may be similar to yours, and you do not acquire rights in other users’ Outputs.

8. Consent and likeness

You may only upload faces and likenesses that are your own, or that you have the explicit, informed permission of the person depicted to use. Each time you upload an Input, you represent and warrant that:

  • you are the person whose face appears in the source photo, or you have obtained that person’s explicit consent to create the specific kind of content you are generating, and you can provide evidence of that consent on request;
  • that person has consented to their face being processed by us and our AI provider to create the Output;
  • every person depicted in your Inputs is at least 18 years old;
  • you own, or have all licenses and permissions needed to use, any video or image you upload as a target scene, including any copyrighted footage, music, or the likeness of other people appearing in it;
  • your Inputs and your use of the Outputs do not violate anyone’s rights of publicity or privacy, intellectual property rights, or any applicable law.

You are solely responsible for your Inputs and for how you use and share Outputs. You agree to indemnify Arche Labs Ltd against any claim arising from a breach of these representations, as described in Section 18.

9. Prohibited uses

Your use of the Service must comply with our Acceptable Use Policy. Among other things, you may not use the Service to create sexual or intimate content, content involving minors, content that harasses, defames, or impersonates another person, content intended to commit fraud or mislead voters, or content that infringes the rights of others. You also may not:

  • reverse engineer, scrape, or attempt to extract the source code, models, or underlying data of the Service;
  • circumvent usage limits, content filters, watermarks, or other safety or security measures;
  • access the Service through automated means except through interfaces we expressly provide;
  • resell or sublicense access to the Service without our written permission; or
  • interfere with or disrupt the Service, its infrastructure, or other users.

10. AI-generated output

Outputs are produced by machine-learning models. They may be inaccurate, imperfect, or different from what you expected, and the same request can produce different results. We do not guarantee that any Output will meet your requirements or be suitable for any particular purpose.

Outputs are synthetic media. You must not present an Output as real, authentic footage of an event or of a person’s actual conduct or statements in a way intended or likely to deceive anyone.

All Outputs include machine-readable metadata identifying them as AI-generated, and Outputs on some plans also carry a visible watermark. You must not remove or alter this labeling. When you share Outputs publicly, you must clearly label them as AI-generated or edited.

11. Third-party AI providers and services

To generate Outputs, we send your Inputs to third-party AI infrastructure providers, currently including Higgsfield AI, which process them on our behalf and return the results. Payments are processed by Stripe and the Service is hosted by Vercel. How these providers handle your data is described in our Privacy Policy. The Service may also contain links to third-party websites that we do not control; we are not responsible for their content or practices.

12. Our intellectual property

The Service, including its software, design, templates, text, graphics, logos, and the GetSwapped name and trademarks, is owned by Arche Labs Ltd or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. Templates we provide may be used only within the Service to create Outputs. If you send us feedback or suggestions, we may use them without any obligation to you.

13. Copyright, likeness, and takedown requests

Copyright complaints

We respect intellectual property rights. If you believe that content made with or stored on the Service infringes your copyright, please send a notice to our designated copyright agent including:

  • your name and contact information;
  • a description of the copyrighted work concerned;
  • the URL or other information that allows us to locate the content;
  • a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  • a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf; and
  • your physical or electronic signature.

We will review notices promptly, remove or disable access to content where appropriate, and may terminate the accounts of repeat infringers. If your content was removed and you believe this was a mistake, you may send a counter-notice to the same address. If we receive a valid counter-notice, we may restore the content after 10 to 14 business days unless the complainant tells us they have filed a court action.

Likeness and intimate-image complaints

If content shows you without your consent, email getswapped.com@gmail.com with a link to or description of the content, your contact details, and a statement that you did not consent. No sworn statement is needed. We remove non-consensual intimate content within 48 hours of a valid report, and other reports from people depicted without consent are prioritized.

14. Content moderation and illegal-content notices (EU Digital Services Act)

We use automated filters and human review to detect content that breaks these Terms or the Acceptable Use Policy. Anyone can report content they believe is illegal by emailing getswapped.com@gmail.com with a description, its location, and an explanation of why it is illegal. We confirm receipt and tell you our decision.

If we remove your content or restrict or close your account, we tell you why, unless the law prevents it. You can challenge the decision by replying to getswapped.com@gmail.com within 6 months. Our single point of contact for EU authorities and users under Articles 11 and 12 of the Digital Services Act is getswapped.com@gmail.com. We communicate in English and Greek.

15. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, remove content, or refuse any request, with notice and a statement of reasons where the law requires it, or without notice where needed to prevent serious harm or comply with law, if we reasonably believe that you have violated these Terms or the Acceptable Use Policy, that your use creates legal or safety risk for us, other users, or third parties, or if we are required to do so by law. Accounts terminated for violations of the consent rules or the Acceptable Use Policy are not eligible for a refund. If we discontinue the Service entirely for reasons unrelated to your conduct, we will give you reasonable notice and refund any prepaid fees for the unused portion of your current billing period. Sections that by their nature should survive termination (including Sections 7, 8, 10, 16 through 19, and 21) will survive.

16. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ARCHE LABS LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT OUTPUTS WILL BE ACCURATE OR RELIABLE. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ARCHE LABS LTD AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or, for consumers in the EU and UK, for breach of statutory consumer rights.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Arche Labs Ltd and its officers, employees, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your Inputs, including any claim that you lacked consent or rights to use a face, likeness, or video; (b) your use or distribution of Outputs; (c) your breach of these Terms or the Acceptable Use Policy; or (d) your violation of any law or the rights of any third party.

19. Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Republic of Cyprus, without regard to its conflict-of-law rules. Subject to the paragraph below, the courts located in the Republic of Cyprus will have exclusive jurisdiction over any such dispute, and you and Arche Labs Ltd consent to their jurisdiction.

If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and nothing in these Terms takes away those protections or your right to bring proceedings in the courts of your country of residence. Before filing any claim, we encourage you to contact us at getswapped.com@gmail.com so we can try to resolve the issue informally; most concerns can be resolved quickly this way.

20. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before the changes take effect, except where changes are required by law or address new features or safety issues, in which case they may take effect immediately. The “Last updated” date above shows when these Terms were last revised. Your continued use of the Service after changes take effect means you accept the updated Terms; if you do not agree, you may cancel your subscription.

21. General

These Terms, together with the policies referenced in them, are the entire agreement between you and Arche Labs Ltd regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
